1. WHAT INFORMATION DO WE COLLECT?

For the purposes of this policy, “personal information” is any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. We collect the following types of information. The information we collect will depend on what you do when you visit our Site.

INFORMATION YOU PROVIDE

We may collect the following information that you voluntarily provide us in using our Site:

  • Create an Account. If you create an account with us, you will provide us with your name, email address, contact information or contact information about your company and you will create a password for future logins.
  • Request for Services. If you contact our customer service department, you may need to provide us with additional information so that we can respond to your questions or concerns as completely and thoroughly as possible. 
  • Business Information. We may collect personal information from business clients or vendors, including company name, physical address, phone number, email address, and credit card information. 
  • Surveys. If you choose to participate in a survey, we may request personal information from you along with other information, in order for you to participate.
  • Promotions. If you enter a sweepstakes, contest, giveaway, or other promotion (each a “Promotion”), you may provide us with your name, residential address, email address, social medial user profile, age or birth date.
  • Newsletter. If you subscribe to our newsletter, you will provide us with your email address.

INFORMATION THAT IS COLLECTED AS YOU NAVIGATE OUR SITE 

In addition, we (and other entities) may automatically gather certain information about your use of the Site. This information may be used to identify your browser or device over time. We use the information we collect to operate and improve the Site and EyeMed’s business, such as to analyze trends, to administer the Site, to understand how visitors use the Site, and to gather demographic information about our user base as a whole. We also use this information to improve the content of our web pages, and to customize the content and layout of our pages.  

Additionally, we may use personal information for any lawful purpose, including the following:

  • Process and fulfill your purchase; including sending you emails to confirm your purchase status and to provide related communications;

  • Provide information regarding vision insurance, vision, vision care and vision correction;

  • Allow you to find an eyecare professional or doctor and schedule eye exams or similar appointments with such persons;  
  • Communicate with you, including responding to your inquiries; 
  • Comply with the law and to maintain the integrity and security of our Platforms;  
  • Defend our legal rights and the rights of others;  
  • Investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, or violations of our Terms of Use and to otherwise fulfill our legal obligations;  
  • Fulfill any other purposes for which you provide it, or any other purpose we deem necessary or appropriate; 
  • Administer a promotion;
  • Any purpose with your consent. 

3. SHARING INFORMATION WITH THIRD PARTIES 

We may share the personal information that we collect with third parties, including the following:  

  • With our service providers to perform services in connection with the operation of our business, including for payment processing and authorization, marketing and promotional material distribution, website maintenance, and data analysis. 
  • With affiliates or joint venture partners we have now or in the future.  
  • With law enforcement or other authorities if we believe that: (i) the law or legal process requires it; (ii) we have received a valid administrative request from a law enforcement agency; or (iii) such release is necessary or appropriate (in our sole discretion) to protect the rights, property, or safety of Luxottica, or any of our respective affiliates, service providers, customers, or (iv) as Luxottica deems necessary to resolve disputes, troubleshoot problems, prevent fraud and otherwise enforce the Terms of Use. 
  • As part of a business transition, such as a merger, acquisition by another company, or the sale of all or a portion of our assets, including as part of a bankruptcy proceeding. 
  • With your consent or as otherwise disclosed at the time of collection or sharing.  

We may share information that has been de-identified or aggregated without limitation.  

4. COOKIES AND SIMILAR TECHNOLOGIES 

“Cookies” are small files of information that are stored by your web browser software on your computer hard drive, mobile or other devices (e.g., smartphones or tablets).  

Like many other companies, EyeMed uses cookies and other tracking technologies (such as pixels and web beacons) (collectively, “Cookies”) when you visit our websites including our blogs and client portals (“Sites”), and use the services provided through our Sites (“Services”). This Cookie Policy explains how we use Cookies and how you can manage them. 

We (and third parties operating on the Site) may use both session cookies and persistent cookies on this Site. We may link the information we store in cookies to your personal information in order to provide a better online experience. 6. CHILDREN’S PRIVACY 

We understand the importance of protecting children’s privacy, especially in an online environment. Our Platforms are not intentionally designed for or directed at children less than 16 years of age. We do not knowingly collect personal information from children under the age of 16 without the consent of the child’s parent or guardian. We encourage parents and guardians to provide adequate protection measures to prevent minors from providing information unwillingly on the internet.  If we are aware of any personal information relating to children that we have collected, we will take steps to securely remove it from our systems.

We maintain reasonable and appropriate safeguards to help protect your personal information from loss and from unauthorized acquisition. We monitor activity on our Platforms to prevent any unauthorized disclosure of information. However, no security measure or modality of data transmission over the Internet is 100% secure. Although we strive to use commercially acceptable means to protect your personal information, we cannot guarantee absolute security. 

8. THIRD-PARTY SITES 

From time to time, this Site may link you to other third-party sites (“Linked Sites”) that are not owned or operated by EyeMed. We do not control the collection or use of any information, including personal information that occurs during your visit to the Linked Sites. 9. DIGITAL ADVERTISING & ANALYTICS 

We may engage and work with service providers and other third parties to serve advertisements on the Site and/or on third-party services. Some of these ads may be tailored to your predicted interests based on your browsing of the Site and across other, unrelated websites and apps over time, including on other browsers and devices that are potentially related.  This practice is sometimes referred to as “interest-based advertising” or “online behavioral advertising”, which may include sending you an ad on a third-party service after you have left the Site (i.e., “retargeting”). 

EyeMed adheres to the Digital Advertising Alliance (“DAA”) Self-Regulatory Principles in connection with this interest-based advertising activity.
